Terms & Conditions

These Terms of Service govern your use of PolarPoll, a website and service operated by Win Media & Advertising d.o.o. ("the Company", "we", "us", or "our"). By accessing or using PolarPoll ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

PolarPoll is an online survey creation and data collection platform operated by Win Media & Advertising d.o.o. We provide tools for building, distributing, and analyzing surveys. The Service is available in free and paid subscription tiers, each with different features and usage limits as described on our Pricing page.

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You agree not to use the Service to: collect data in a deceptive or misleading manner; send spam or unsolicited messages; distribute surveys containing illegal, harmful, or offensive content; violate any applicable laws or regulations, including the EU General Data Protection Regulation (GDPR) and applicable national data protection laws; infringe on the intellectual property rights of others; attempt to gain unauthorized access to any part of the Service or its infrastructure; or resell or redistribute the Service without our explicit written permission.

Your use of the Service is also governed by our Privacy Policy. By using PolarPoll, you consent to the collection and use of your data as described therein. You retain ownership of any data and content you submit to the Service. By using the Service, you grant Win Media & Advertising d.o.o. a limited licence to store, process, and display your content solely for the purpose of providing the Service to you.

Win Media & Advertising d.o.o. uses the following sub-processors to provide the Service. By accepting these Terms, you authorise the Company to engage these sub-processors:

Hostinger International Ltd — Cloud infrastructure and server hosting. Data may be stored in the EU (Lithuania) or other Hostinger data centre locations. Privacy policy: hostinger.com/privacy-policy.

Paddle.com Market Ltd — Merchant of Record and payment processor. Paddle handles billing, subscription management, and tax compliance on our behalf. Privacy policy: paddle.com/privacy.

Google LLC (Gemini API) — Used exclusively when you or your users choose to generate surveys using the AI Survey feature. Only the prompt text is sent; no account or respondent data is transmitted. Privacy policy: policies.google.com/privacy.

We will notify you of any intended changes to sub-processors and give you the opportunity to object before the change takes effect.

Win Media & Advertising d.o.o. implements appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access. In the event of a personal data breach likely to result in a risk to the rights and freedoms of natural persons, we will notify you without undue delay and, where feasible, within 72 hours of becoming aware of the breach, providing sufficient information to allow you to meet any reporting obligations you may have under applicable law.

Paid subscription plans are billed on a monthly basis. You may cancel your subscription at any time, and your access to paid features will continue until the end of the current billing period. We reserve the right to change our pricing with reasonable advance notice. All fees are non-refundable except where required by applicable law or as set out in our Refund Policy.

All intellectual property rights in the Service, including but not limited to software, design, logos, and trademarks, are owned by Win Media & Advertising d.o.o. or its licensors. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the Service as permitted herein.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, Win Media & Advertising d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease. We will delete your account data within 30 days of termination, except where retention is required by law.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Republic of Serbia. Where mandatory EU consumer protection law applies, it shall take precedence.
